To the editor: Who holds ICAC to account?

I was saddenedย to see Gladys Berejiklian resignย due to the totally unnecessary andย mistimed announcementย by the NSW ICAC that she was under further investigation. Itย was unnecessary at this time as we are inย the middle of a pandemic and also as ICAC will, if true to form, investigate it at their leisure. ICAC could have waited.ย 

Her resignation deprives the peopleย of NSW, and indeed Australia, of a much respected, well liked and able leader at a crucial time inย our history. I’m sureย her likely replacementย Dominic Perrottet will prove a fine premier but ICAC’s handling of this matter poses a numberย of questions.ย 

Gladys fundamentally seems guilty at worst ofย making a bad choice in forming a relationship with Mr McGuire and on the information toย date may well be cleared of any wrongdoing.ย 

I am suspicious ofย ICAC and it has always worried me thatย Nick Greinerย (himself an innocentย victim of it) set up a star chamber answerable to no-oneย where people are presumedย guilty and have to prove their innocence.

It is also very suspicious thatย three goodย people and former NSW Liberal Premiers have been the principal victims: Nickย Greinerย – subsequently cleared of any wrongdoing, in appointing an independent memberย to a government position; poor old Barry O’Farrell, a fineย  man I knew well, beingย crucified over forgetting about being given a good bottleย of red wine, whoย  was subsequently cleared of any wrongdoing; and now Gladys.

Federal Liberal Memberย of Parliamentย Jason Falinski is worthย quoting here when he told the Weekendย Australian: “ICAC continues to perpetuateย gross injustices. It is an organisation who openly threatened the parliamentย if it did not getย a budget increase. It is an organisationย thatย could not find any corruptionย in the Carr and Keneally governmentย until they were voted out of officeย and then refused to investigate any activities going backย two years.”

Three NSW premiers have lost their job becauseย of ICAC and many otherย  innocentย peopleย have had their lives turned upside down and wrecked unfairly as a result ofย ICAC’s actions; heroic Crown Prosecutor, Margaet Cunneen, the bane of Sydney pack rapists comes to mind here. Who investigates and holds accountable the ICAC inquisitors? No one, it seems.ย 

ICAC, in my view, is a tarnishedย organisation, where obvious accusations of political bias can beย leveled at. It’s time for the NSW parliament to get ridย of it. There isย one body thatย can usuallyย  beย trusted to upholdย and apply the law fearlessly and without favour and that is the AFP and most (not sure about Victoria) of our stateย ย policeย forces. They are also governedย by that tried and true principle ‘innocent until proven guilty’ and are overseen by parliament.ย 

The federal parliament would be mad in the circumstances to create a federal ICAC.
